A frontline Nigerian legal firm, Falana and Falana’s Chambers, has confirmed that a Fundamental Rights Enforcement action has been filed and accepted by the Federal High Court over the alleged assault of Dr. Pedro Obaseki on December 28, 2023, in Benin City, Edo State.
In a statement, Femi Falana, SAN, said the action was commenced by Originating Motion on Notice in line with relevant provisions of the 1999 Constitution (as amended), the Fundamental Rights (Enforcement Procedure) Rules, 2009, and applicable provisions of the African Charter on Human and Peoples’ Rights.
The suit names eleven individuals as respondents, namely Osazee Kabaka Adun (alias “Kapuepue”), Osayande Obakhavbaye, Gege Izua Adun, Osamede Nomoless Eriyo, Julius Imafu, Uyigue Obazehowan, Osamiemwanfan Ojo (alias “Sales Guy”), Rambo Izua Adun, Uwaifo Orhue Oguigo, Osaro Iyamu (alias “Culture”), and Chris Osa Media, together with the State Security Service (SSS/DSS) and the Honourable Attorney-General of the Federation.
According to court filings, Dr. Obaseki alleges he was violently abducted during a recreational outing and assaulted.
The claimant is seeking declarations that his fundamental rights were violated, an order restraining further harassment, and directives for investigation and prosecution of those involved. He is also requesting a public apology in two national newspapers and N500 million in damages.
