A Benin High Court, presided over by Vacation Judge, Justice Mary Itsueli, has restrained the Edo State Independent Electoral Commission from conducting a by-election across fifty-nine wards to fill vacancies in the legislative seats or offices of Councillors sponsored by the Peoples Democratic Party when their tenure subsists until September 2026.
The Court also granted an order for the State Electoral Commission to stay further action or take any further step in connection with the planned Local Government by-election across fifty-nine wards in the Local Government Area of Edo State, relating to the seats or offices of the duly elected Councillors in their respective wards, pending the hearing and determination of a motion Ex-parte filed by the Peoples Democratic Party.
The case has been referred to the State Chief Judge for assignment to a regular court.
