
Benin High Court Dismisses Preliminary Objection To Stop Case Between Edo State Government And Ugbowo Community.
A Benin High Court presided over by Justice M.N. Asemota has dismissed the preliminary objection of Edo State government, the Attorney General of the state, Edo State Geographical Service, Federal Ministry of Land and Housing and Urban Development, University of Benin, and UBTH, among others, against Sunday Enodolowanyi and Chief Ero Osemengie and others on behalf of Ugbowo community.
In the ruling, Justice Asemota said the defendants were unable to convince the court why it should not hear the case of the claimant because their defense lacks merit.
Justice Asemota, however, awarded a cost of fifty thousand Naira against the defendants.
With this ruling, however, all is now set for the hearing of the case proper between Ugbowo community, Edo State government, and some of its agents, and the federal government and some of its agents over the disputed large parcel of land, which Ugbowo community says was unlawfully taken over by the defendants.
